Welcome to the services of SPHERA Internacional.
Our goal is to enable a safe, high quality experience, allied to medical services with excellence and accessible prices. We work as facilitators/assistants to your trip and required medical services, since your first contact and initial consultation until you return home, through the site www.brazilmedicaltourism.com and/or personal contact.
Medical and surgical information provided by SPHERA Internacional on the site www.brazilmedicaltourism.com or any other communication media aims to inform you and increase your knowledge. However, any opinion should be understood and widely discussed with the doctor or surgeon before the procedure, having SPHERA Internacional no direct or indirect responsibility over the services and medical and/or surgical procedures adopted.
These terms and conditions define the agreement established between the customer (the “contracting party”), SPHERA Internacional, and the surgeon chosen to perform the medical procedure, the latter being the contracting party’s personal choice. The Terms and Conditions document summarizes, among other things, what is or isn’t included in the price and service provided by SPHERA Internacional, as well as what happens if the contracting party requires additional medical services or needs to stay in the hospital, practice and/or destination longer than planned.
SPHERA Internacional’s role is to act as a facilitator between the contracting party, the hospitals, practices, laboratories, surgeons, doctors and any other medical or touristic service provider with which it is affiliated. We work aiming the contracting party’s interest as part of the process.
SPHERA Internacional does not recommend, endorse or issue any sort of exam, procedure or opinion on the medical procedure that should be adopted or chosen by the contracting party. It also does not recommend or assign any specific doctor, hospital or medical center, as those must be a personal, exclusive choice of the contracting party.
The contracting party must be aware and in agreement with all the details of the procedure(s) and, if there is any aspect still unclear, please try to clarify it before signing this agreement.
It is important to be aware that every surgery involves risk and there may be a dissatisfaction with the final result, in which case SPHERA Internacional will not be held resonsible in any way.

Personal Information
Basic personal information:
It is fundamental that the contracting party supplies precise information so we can provide the best service possible. The lack of information and/or incorrect information might result in delays and diminished effectiveness from SPHERA Internacional, or even the impossibility to provide some sort of hired service.
In order to supply to the contracting party the budget and detailed information regarding the desired procedure, SPHERA Internacional will share his/her information with the health providers, already being authorized to do so.
All communication with the contracting party will be made through the data provided by him/her – fax, email, telephone or letter – regarding the planned medical treatment, medical information, and travel details.
The personal documentation required by each country for travel procedures, as well as passports, visas, vaccines, etc., is the contracting party’s responsibility. Therefore, the impossibility to travel due to a lack of documentation may result in the postponing or even cancelling of the hired medical procedures, and in this case, SPHERA Internacional will not be held responsible, being applied on the contracting party the penalties forecasted in these Terms and Conditions.
Service Pricing It is the price that appears in the “Service-Rendering Agreement”, approved by the contracting party electronically.
The amount to be payed will be fixed in Reais (R$ - Brazilian currency) for Brazilian customers, in American Dollars (US$) for international customers, in Euros (€) for European clients, always at SPHERA Internacional’s discretion.
Service-Rendering Agreement It is the document in which the contracting party chooses, confirms and accepts the treatment that will be applied and the hired services, and where his/her personal data, chosen doctor, practice, hospital, total amount of the services, and payment mode will appear.
Confidentiality and Privacy SPHERA Internacional is extremely careful in order to assure that its service providers are judicious at accomplishing their obligations of confidentiality and privacy, always aiming to protect the personal information of the CONTRACTING PARTY. The safeguard measures to protect the medical information are one of SPHERA Internacional and its partners’ main concerns.
Payment After receiving electronical confirmation of the “Service-Rendering Agreement” by the CONTRACTING PARTY, the latter must pay a non-refundable down payment, which represents a guarantee so that SPHERA Internacional may arrange all services hired by the contracting party.
The payment of the down payment must be made in the maximum period of 10 (ten) days after approval of the “Service-Rendering Agreement”. After this period, the contract may be subject to eventual alteration or cancellation.
The total amount/value of the services hired through SPHERA Internacional must be made by the contracting party previous to the date on which the beginning of the services take place.
Alterations and Cancellation The alteration or cancellation of any of the services hired through SPHERA Internacional must be requested in writing through email or fax, and the costs originated by such alterations or cancellation will be fully undertaken by the CONTRACTING PARTY.
Each service provider hired by the contracting party through SPHERA Internacional has its own alteration and cancellation policy. The contracting party agrees that SPHERA Internacional has no control over eventual fees that might be charged.
The alteration or cancellation of lodging dates must be made within up to 48 hours, without the imposition of fees.
The airplane tickets are subject to different alteration and cancellation rules and fees, according to each company’s policy.
Travel Insurance Every client resident abroad must acquire in their origin country an international travel insurance that includes medical expenses due to accidents.
General Terms The value of the budget approved by the contracting party may suffer alterations and be modified after the first evaluation and mandatory consult with the doctor that will perform the procedure. This alteration will be widely demonstrated and discussed with the contracting party, who must agree and approve of it previously, before any procedure is performed.
In case the contracting party does not agree with the new medical expenses and decides against the procedure, the contracting party will be reimbursed with the value of the service, minus the non-refundable signal and the expenses already incurred by him/her, taking into account the policies of devolution of the hired service renderers.
The contracting party assumes responsibility to pay for any unforeseen and additional medical expenses intended for his/her safety and health, during the procedure or in postoperative, in which SPHERA Internacional has no involvement or responsibility.
The expenses made by the contracting party and not included in the budget approved in the “Service-Rendering Agreement”, must be paid directly by the contracting party to his/her service providers.
General Agreement By cepting the terms and conditions established in this document, the contracting party agrees and recognizes that SPHERA Internacional is merely a facilitator in the hiring of services chosen only by the contracting party, maintaining the company’s goal to bring quality medical services to the contracting party’s reach.
The contracting party accepts and recognizes that the decision to undergo the hired medical treatment in entirely theirs, and does not make SPHERA Internacional responsible for any consequence that this decision might imply. SPHERA Internacional is not responsible for the medical action; our responsibility is limited to our care and proficiency as a facilitator.
SPHERA Internacional is not responsible for delays or impossibility to perform the medical procedures hired deriving from the hypotheses of unforeseen factors originated from Act of God and force majeure in conformity with art. 393 of the New Civil Brasilian Code.
Jurisdiction By accepting this document, the contracting party agrees that any judicial action against SPHERA Internacional and its affiliates, subsidiaries, employees, contracting parties, managers, directors, and suppliers in general, must be made through the Central Forum of São Paulo State Capital - Brazil.
These terms and conditions are ruled and in accordance with Brazilian principles and laws.
If any of the items of the Terms and Conditions is invalidated by a competent court or jurisdiction, the invalidity of this provision shall not affect the validity of the other items present in this document (Terms and Conditions), which remains with total force and effect. | ||||||||
